This website is not directed to children under the age of thirteen. We will not knowingly collect personal data from children under the age of thirteen without insisting that they seek prior parental consent if required by applicable law. California’s “Shine the Light” law permits those of our customers who are California residents to annually request a list of their personal data (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year, and the names and addresses of those third parties. Currently, we do not share any personal data with third parties for their direct marketing purposes.
Siemens Digital Industries Software is responsible for the processing of personal data it receives under the Privacy Shield Framework and subsequently transfers to a third party acting as an agent on its behalf. We may transfer personal data to a third party acting as an agent for Siemens Digital Industries Software for limited and specified purposes without consent if the third party: (i) has certified to the Privacy Shield Principles, (ii) is subject to laws meeting the minimum requirements of the EU Directive on Data Protection, or (iii) has entered into an agreement with Siemens Digital Industries Software in which the third party agrees to provide the same level of protection as required by the Privacy Shield Principles. Upon notice from the third-party agent that it does not comply with its privacy obligations, we will take commercially reasonable and appropriate steps to prevent or stop unauthorized processing of personal data by that third party. However, Siemens Digital Industries Software acknowledges that it remains potentially liable under the Principles for the actions of its agents unless Siemens Digital Industries Software proves that it is not responsible for the event giving rise to the damage.
With respect to personal data received or transferred pursuant to the Privacy Shield Framework, Siemens Digital Industries Software is subject to the regulatory investigation and enforcement powers of the U.S. Federal Trade Commission. In certain situations, Siemens Digital Industries Software may be required to disclose personal data in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.
Siemens Digital Industries Software enters into agreements with our customers that request services from us with respect to and/or provide us with personal information for us to provide services. In such cases, Siemens Digital Industries Software fulfills such requests for services from such customers based on their instructions, except for due diligence investigations which are conducted for commercial purposes.
Upon reasonable request, Siemens Digital Industries Software will provide E.U. residents with reasonable access to personal data held about them and allow them to correct, amend or delete information where inaccurate or processed in violation of the Privacy Shield Principles. The Privacy Shield Principles provide exceptions to the obligation to provide access to allow corrections, amendment or deletion of personal data. Access to confidential or proprietary information such as business information, or where granting access must be balanced against the privacy interests of others may be restricted. In addition, access may be denied: (i) when the information requested relates to an ongoing investigation, litigation or potential litigation; (ii) where the burden or expense of providing access would be disproportionate to the risks to the privacy of the EU Person, or (iii) when the rights of persons other than the EU Person would be violated.
