Siemens PLM Software will not directly collect any personal data about you (such as your name, address, telephone number or e-mail address), unless you voluntarily choose to provide it (such as by registration, survey or order placement), or unless otherwise required by applicable laws and regulations. From time to time, we may collect personal data about you indirectly from sources other than through our own Internet sites. The personal data that we collect from various sources may be combined.
When you or your organization sign up to use our site or services, or request additional information about our products and services, we may receive certain information such as your name, job title, address, phone number or other types of personal data.
To access some of our products and services you may be required to provide us specific information that allows us to verify your identity before accessing certain data we host. This information is only used to assist you in accessing such account or information.
When you access our Internet sites or use our mobile applications, we may automatically (that is, not by registration) collect additional data (such as type of Internet browser, IP address, operating system used, domain name of the Internet site which directed you to our site, number of visits, average time spent on the site, pages viewed, information on your interaction with the site). We may use this data and share it with our worldwide affiliates or third parties to monitor the attractiveness of our Internet sites and mobile applications, improve the performance or content, tailor content for you or for other marketing purposes.
We may use your personal data to offer the site’s services and functions, to administer your use of the site, to respond to your inquiry or request, to process your order or to provide you with access to specific information or offers, to verify your identity, as well as to support our existing or potential customer relationship with you. Siemens may store and process personal data (on our own or via a third party on our behalf) and share it with our worldwide affiliates (meaning
entities controlled by, controlling, or under common control with Siemens) to understand better your business needs and how to implement and improve our business practices, products and services. We (or a third party on our behalf) may use personal data to contact you about an offer in support of your business needs or to conduct online surveys to understand better our customers' needs. To the extent required to help us fulfill your orders or requests, we may share personal data with others, such as our business partners, postal/logistics companies, or customs agents/authorities.
We may transfer your personal data and process it outside your country of residence. We may transfer your personal data if we sell or transfer all or a portion of our business or assets, including to any successor company whether via merger or otherwise.
To the extent that our Internet sites do collect personal data about an individual’s online activities, these sites may, in our discretion, be configured to allow collection of such personal data over time and across different Internet sites.
Our Internet sites use a variety of third-party analytics to improve the site, identify errors, and/or customize the information included in the site. To exclude your computer or device from the data aggregation and analysis by third parties due to your visit to this Internet site, a cookie will be placed on your machine. In addition, we may advertise using online marketing technology. Siemens PLM Software may transfer your personal data to its parent company in Germany, Siemens AG, and to any worldwide affiliates when processing data. We may also transfer your data to a third party outside your country of origin.
Currently our Internet sites do not recognize or respond to “Do Not Track” browser signals. For more information on “Do Not Track”, please visit your browser’s support page.
This website is not directed to children under the age of thirteen. We will not knowingly collect personal data from children under the age of thirteen without insisting that they seek prior parental consent if required by applicable law. We will only use or disclose personal data about a child to the extent permitted by law, to seek parental consent, pursuant to local law and regulations, or to protect a child.
To protect your personal data against accidental or unlawful destruction, loss, use, or alteration and against unauthorized disclosure or access, Siemens uses reasonable physical, technical, and organizational security measures. Unfortunately, there is no complete assurance of security in transit or storage of any data that you transmit. Your personal data may be accessed, disclosed, altered, or destroyed by a breach of any of the physical, technical, or organizational assets.
California’s “Shine the Light” law permits those of our customers who are California residents to annually request a list of their personal data (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year, and the names and addresses of those third parties. Currently, we do not share any personal data with third parties for their direct marketing purposes.
Siemens PLM Software is responsible for the processing of personal data it receives under the Privacy Shield Framework and subsequently transfers to a third party acting as an agent on its behalf. We may transfer personal data to a third party acting as an agent for Siemens PLM Software for limited and specified purposes without consent if the third party: (i) has certified to the Privacy Shield Principles, (ii) is subject to laws meeting the minimum requirements of the EU Directive on Data Protection, or (iii) has entered into an agreement with Siemens PLM Software in which the third party agrees to provide the same level of protection as required by the Privacy Shield Principles. Upon notice from the third-party agent that it does not comply with its privacy obligations, we will take commercially reasonable and appropriate steps to prevent or stop unauthorized processing of personal data by that third party. However, Siemens PLM Software acknowledges that it remains potentially liable under the Principles for the actions of its agents unless Siemens PLM Software proves that it is not responsible for the event giving rise to the damage.
With respect to personal data received or transferred pursuant to the Privacy Shield Framework, Siemens PLM Software is subject to the regulatory investigation and enforcement powers of the U.S. Federal Trade Commission. In certain situations, Siemens PLM Software may be required to disclose personal data in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.
Siemens PLM Software enters into agreements with our customers that request services from us with respect to and/or provide us with personal information for us to provide services. In such cases, Siemens PLM Software fulfills such requests for services from such customers based on their instructions, except for due diligence investigations which are conducted for commercial purposes.
Upon reasonable request, Siemens PLM Software will provide E.U. residents with reasonable access to personal data held about them and allow them to correct, amend or delete information where inaccurate or processed in violation of the Privacy Shield Principles. The Privacy Shield Principles provide exceptions to the obligation to provide access to allow corrections, amendment or deletion of personal data. Access to confidential or proprietary information such as business information, or where granting access must be balanced against the privacy interests of others may be restricted. In addition, access may be denied: (i) when
the information requested relates to an ongoing investigation, litigation or potential litigation; (ii) where the burden or expense of providing access would be disproportionate to the risks to the privacy of the EU Person, or (iii) when the rights of persons other than the EU Person would be violated.
If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact our U.S.-based third-party dispute resolution provider (free of charge) at feedback-form.truste.com/watchdog/request . Under certain conditions, more fully described on the Privacy Shield Website you may invoke binding arbitration when other dispute resolution procedures have been exhausted.
