This Sweepstakes ("Sweepstakes") is open to persons 18 years of age and older who are registered users of Second Life at the time of entry. This promotion is not open to employees of Siemens Product Lifecycle Management Software Inc. (hereinafter “Siemens PLM Software”), its subsidiaries, affiliates, resellers, advertising and promotional agencies or members of their immediate families. Sweepstakes is subject to all applicable federal, state, provincial, territorial, municipal and local laws and regulations. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Sweepstakes to be held 10:00 AM (Eastern) May 26, 2008 through 10:00 AM (Eastern) June 23, 2008 (herein after “Promotion Period”). Six registered participants from the Sweepstakes will win a prize. Limit one entry per registered participant (hereinafter “Participant”).

During the Promotion Period, visit http://secondlife.com/ and follow the links and instructions to login and/or create a Second Life® membership. Creating a Second Life membership is free. The potential winner may be required to show proof of being the authorized account holder. The provided Second Life orientation should take less than 15 minutes to complete. Once registered with a Second Life avatar, visit Siemens Innovation Connection to start the scavenger hunt.

The prizes are: one (1) T-Fal® Avanté Deep Fryer (approximate retail value $80.00), and five (5) 3Dconnexion SpaceNavigator™ PE controllers (approximate retail value $59.00 each) (hereinafter the “Prize” or collectively the “Prizes”). Limit no more than one prize per registered Participant.

Any tax contributions or incidental expenses arising from the Prizes shall be the sole responsibility of the relevant winner. Any Prize granted in the course of the Sweepstakes shall be subject to any restrictions that may be imposed on the provision of such Prize by the local or international or government authorities generally or to specific identified individuals.

Cash alternatives will not be given in lieu of Prizes. No Prize substitution shall be granted except at the sole discretion of Siemens PLM Software. If a Prize cannot be granted due to circumstances beyond the control of Siemens PLM Software, a substitute Prize of equal value will be provided.

Participant may not enter with multiple identities nor may Participant use any other device or artifice to obtain more than the maximum number of entries. Any Participant who attempts to participate multiple times or with multiple identities or uses any device or artifice to obtain more than the maximum number of entries may be disqualified. Multiple Participants are not permitted to share the same email address or Second Life membership. Any attempt by any Participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, Second Life memberships, or any other methods will void that Participant's entries and that Participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to create a Second Life membership will be deemed to be the Participant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

Siemens PLM Software is not responsible for: (1) any incorrect or inaccurate information, whether caused by Participant, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an Participant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant's sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Siemens PLM Software, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Siemens PLM Software reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

By entering the Sweepstakes, Participant agrees that any problems with the functionality of the virtual environment Second Life are subject solely to Linden Lab’s responsibility and that Siemens PLM Software cannot be held liable in any way for any kind of problems or malfunctions of the service provided by Linden Lab.

The drawing will be held on June 24, 2008 at 3:00 PM Eastern. The drawing will be conducted by Siemens PLM Software whose decision is final on all matters relating to this Sweepstakes. Winners need not be present at the drawing to win. Odds of winning are dependent upon the total number of entries received. Each winner will be notified by e-mail within ninety-six (96) hours of the time of the drawing. Each winner will have ninety-six (96) hours to respond to the notification to confirm acceptance of the Prize. If a winner has not responded to Siemens PLM Software by the conclusion of 96 hours from the time of notification, a new winner will be selected by random drawing. Selection of winners will continue until a total of six selected winners respond by the conclusion of 96 hours from the time of notification. Each Prize will be delivered to the address provided by Participant. Winners are responsible for all applicable federal, state, and local taxes. Siemens PLM Software will cover shipping costs, including international shipments. All Prizes will be awarded and are non-transferable.

By submitting an entry for this Sweepstakes, Participant agrees to abide by these official rules and any decision Siemens PLM Software makes regarding this Sweepstakes. Siemens PLM Software reserves the right to disqualify from this Sweepstakes, and to prosecute to the fullest extent permitted by law, any Participant or winner who, in Siemens PLM Software’s reasonable suspicion, tampers with the entry process, intentionally submits more than a single entry or mechanical entries, violates these official rules, or acts in an unsportsmanlike or disruptive manner.

By submitting an entry for this Sweepstakes, Participant(a) agrees to the decisions of Siemens PLM Software which shall be final in all respects; (b) consents to the use of winners’ name, likeness and any statements, quotes or testimonials provided by the winner for advertising and publicity purposes without further compensation, except where prohibited by law; (c) and agrees to hold harmless and fully indemnify and release Siemens PLM Software, its subsidiaries, and affiliates, and their directors, officers, employees and agents from any and all liability, damages, or causes of action (however named or described) caused by or arising out of Participant's participation or acceptance, possession or use of any prize.

If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Siemens PLM Software, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Siemens PLM Software reserves the right to cancel, terminate, modify or suspend this Sweepstakes and conduct a random drawing to award the Prizes using all eligible non-suspect entries received as of the termination date. If the Sweepstakes is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at http://www.plm.automation.siemens.com/giveaways.

Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Siemens PLM Software in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas, U.S.A.

This Sweepstakes, the rights and obligations of Siemens PLM Software, and the rights and obligations of Participants and winners will be governed and controlled by the laws of Texas, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings, and litigation relating hereto will be instituted and prosecuted solely within the State of Texas. The parties consent to the jurisdiction of the state courts of Texas and federal court located within the state and county with respect to any action, dispute, or other matter pertaining to or arising out of this promotion. Sweepstakes is void where prohibited.

By entering this Sweepstakes, Participant acknowledges and agrees to Siemens PLM Software’s collection and use of Participant’s personal information, such as name, address, telephone number and e-mail address, for any purpose, including but not limited to, contacting Participant from time to time to inform Participant of products, programs, services and promotions that Siemens PLM Software believes may be of interest to Participant.
